Acceptable Use Policy

Guidelines for responsible use of the All Set platform and its communication tools.

This Acceptable Use Policy ("AUP") governs your use of the All Set platform, with particular attention to SMS, email, voice, and other communication features. The All Set platform is a powerful communication tool — and with that power comes responsibility. This policy exists to protect you, your customers, and the integrity of the platform from misuse.

1. SMS and Text Message Compliance (TCPA)

The Telephone Consumer Protection Act (TCPA) imposes strict requirements on commercial text messaging. Violations can result in statutory damages of $500 to $1,500 per message. As a user of All Set's SMS features, you are solely responsible for ensuring your SMS campaigns comply with the TCPA and all other applicable laws.

You MUST:

  • Obtain express written consent from each recipient before sending any marketing SMS. This means a clear, affirmative action by the recipient (e.g., checking a box, signing a form, or sending an opt-in keyword) specifically consenting to receive text messages from your business.
  • Include clear opt-out language in every SMS (e.g., "Reply STOP to unsubscribe").
  • Honor opt-out requests within 10 business days. The All Set platform processes opt-outs automatically when properly configured.
  • Send messages only between 8:00 AM and 9:00 PM in the recipient's local time zone.
  • Register your business and SMS campaign with The Campaign Registry (TCR) for A2P 10DLC compliance before sending any SMS campaigns. This is a carrier requirement since 2023. Without registration, SMS deliverability drops significantly and your messages may be blocked.

You MUST NOT:

  • Send SMS to contacts who have not provided express written consent.
  • Use purchased, rented, scraped, or third-party contact lists for SMS marketing.
  • Send messages to numbers on the National Do Not Call Registry for telemarketing purposes.
  • Use auto-dialers for voice calls without prior express consent.
  • Spoof caller ID or sender information.
  • Send deceptive, fraudulent, or misleading messages.

2. Email Marketing Compliance (CAN-SPAM)

The CAN-SPAM Act establishes requirements for commercial email. Violations can result in penalties of up to $51,744 per email. You are responsible for ensuring your email campaigns comply with CAN-SPAM and all other applicable laws.

You MUST:

  • Include your physical mailing address in every marketing email.
  • Include a clear and conspicuous unsubscribe mechanism in every marketing email. The All Set platform includes this by default.
  • Honor unsubscribe requests within 10 business days.
  • Use accurate "From" names and email addresses that correctly identify your business.
  • Use subject lines that accurately reflect the content of the email.
  • Clearly identify promotional emails as advertisements if required.

You MUST NOT:

  • Send marketing emails to purchased, rented, or scraped contact lists through the Platform.
  • Use misleading or deceptive subject lines.
  • Conceal or obscure the unsubscribe mechanism.
  • Continue sending marketing emails to contacts who have unsubscribed.
  • Use false or misleading header information.

3. Prohibited Content and Activities

The following content and activities are strictly prohibited on the All Set platform regardless of the communication channel used:

  • Content that is illegal, defamatory, obscene, or fraudulent.
  • Phishing, scamming, or impersonation of any person or entity.
  • Promotion of illegal products or services, including controlled substances, weapons, or counterfeit goods.
  • Harassment, threats, or abusive communications.
  • Transmission of malware, viruses, or other harmful code.
  • Pyramid schemes, multi-level marketing that violates applicable law, or other deceptive business practices.
  • Content that infringes the intellectual property rights of any third party.
  • Any activity that violates applicable federal, state, or local law.

4. Enforcement

All Set monitors platform usage for compliance with this AUP. Violations are addressed according to the following framework:

Warning: For first-time or minor violations (such as missing opt-out text in an SMS), All Set will issue a written warning with a 48-hour deadline to correct the issue. Failure to correct the violation within the deadline will result in suspension.

Suspension: For serious violations (such as sending to purchased lists) or repeated minor violations, All Set will suspend your account's SMS and/or email capabilities and require a remediation call before reinstatement. Suspension does not entitle you to a refund.

Termination: For repeated violations, violations that result in legal complaints or regulatory action, or violations that pose significant risk to the platform or other users, All Set will terminate your account immediately without refund.

All Set reserves the right to cooperate with law enforcement and regulatory authorities investigating violations of applicable law and to disclose information about your account as required.

5. Reporting Violations

If you believe another user of the All Set platform is violating this AUP, or if you have received unsolicited communications from an All Set user, please report it to [email protected]. Include as much detail as possible, including the sender's information, the content of the communication, and the date and time it was received. We take all reports seriously and will investigate promptly.
